CONCACAF ACCREDITATION TERMS AND CONDITIONS

Each individual (“Bearer”) granted a credential card for access to any Concacaf competition, match, or related event including, without limitation, official practices, press conferences, interviews, and/or any other activities associated with such Concacaf competition, match, or related event (the “Events”), on behalf of his/her employer or assigning organization (“Employer”), hereby agrees to the following terms and conditions throughout the duration of the Events (including, without limitation, on match days and non-match days).

Employers may submit applications for credential cards for a group of persons employed or contracted by the Employer. For applications submitted by an Employer on behalf of various applicants, the Employer hereby warrants and declares that (a) they have provided these terms and conditions to all applicants for whom the Employer is submitting applications, (b) all such applicants have read, accepted, and provided their express consent to these terms and conditions in a manner consistent with applicable law, and (c) Employer shall ensure that all such applicants comply with the terms and conditions contained or referenced herein.

The Bearer agrees that by accepting a credential card, the Bearer acknowledges and agrees that the terms and conditions contained or referenced herein shall apply to him/her and his/her Employer. For the avoidance of doubt, the terms, conditions, obligations, and restrictions contained or referenced herein shall apply and govern regardless of whether the Bearer submitted his/her accreditation application directly to Concacaf or by and through his/her Employer on his/her behalf.

GENERAL

Each Bearer must be, and hereby represents that he/she is, acting on a specific assignment for his/her Employer, including, without limitation, an accredited media agency, and has a legitimate working function in conjunction with the Events. A Bearer’s credential card is non-transferable and may be revoked by Concacaf at any time, with or without cause.

The rights and privileges granted to Bearer shall automatically terminate if any term of this credential card and/or Concacaf statute, regulation, guideline, directive, policy, or code, is breached by Bearer or his/her Employer. The unauthorized use of a credential card shall subject the Bearer and his/her Employer to the immediate revocation of the Bearer’s credential card, ejection from the Event, and prosecution for criminal trespass, without limiting any other rights and remedies at law or in equity.

Each Bearer shall at all times visibly wear and display his/her issued credential card and consents to the reasonable inspection of his/her person and property before entering any venue and/or during any Event. While within the Event venue, Bearer shall at all times adhere to and abide by the policies and procedures in place for each Event, as well as comply with any access limitations of any Event venue, as determined by Concacaf and/or its designees. Each Bearer shall not at any time display, post, or otherwise reproduce the credential card’s image on any digital platform, including, without limitation, online social media sites or applications (e.g., Facebook, X (formerly Twitter), Instagram, Snapchat, LinkedIn, etc.). Additionally, Bearer shall not broadcast, telecast, film, record, transmit, display, or otherwise distribute, nor shall Bearer allow any other party to distribute, footage or content of the Events on a live or near-live basis, including via any real-time online streaming applications or other platforms.

Bearer assumes all risks incidental to the performance by Bearer of Bearer’s services in connection with the Events and assumes all risks incidental to the Events, whether occurring before, during, or after the actual playing of the Events, and agrees that Concacaf, the Event venue, member associations, participating teams/clubs, venues, and their respective employees, directors, officers, players, coaches, team delegation members, match officials, referees, and contractors shall not be liable for injuries or loss of personal property or equipment connection therewith.

Bearer further agrees to release Concacaf and all persons, member associations, participating teams/clubs, and/or any other entities or third parties involved in the management or production of the Events from any claim or liability arising from failure to provide space for telecasting/broadcasting, or other facilities for the television/radio station, Internet media, network, cable system, or any other media entity.

In the event that the name or likeness of the Bearer is included in any broadcast, telecast, photograph, film, video, or other media taken in connection with any Event, the Bearer grants Concacaf the non-exclusive, transferable, royalty-free, perpetual right and license to use (and to sublicense the use of) such Bearer’s name and likeness in any media worldwide whether now known or thereafter devised.

Bearer agrees to indemnify and hold harmless Concacaf and its officers, agents, contractors, employees, the Event venue, and each of the member associations and participating teams/clubs and their officers, agents, and employees, of and from any and all claims, demands, causes of actions, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of anything done or purported to have been done by Bearer and/or his/her Employer, including, without limitation, Bearer’s breach of any term of these credential card terms and conditions and/or any Concacaf statute, regulation, guideline, directive, policy, or code. With respect to any claim that might give rise to liability of the Bearer as an indemnitor, Concacaf shall (a) have the right to fully participate in the litigation of such claim with counsel selected by Bearer and approved by Concacaf at the sole expense of the Bearer, and (b) not be obligated to participate in any settlement of any such claim without its written consent. To the fullest extent permitted under applicable law, these terms and conditions shall be governed by, construed, and interpreted in accordance with the laws of the State of Florida, U.S.A., without giving effect to Florida’s conflict of law provisions.  For all disputes and in connection with these terms and conditions, the parties will seek to resolve such dispute amicably. In case of failure to reach an amicable solution, the exclusive place of jurisdiction to resolve any dispute shall be the state courts of Florida and to the jurisdiction of the Miami-Dade Courts.

Each Bearer hereby acknowledges and agrees that he/she shall be subject to and comply with all applicable Concacaf and FIFA statutes, regulations, guidelines, directives, policies, and codes, including, without limitation, the FIFA Safeguarding and Anti-Discrimination Code of Conduct for FIFA Competitions (accessible at https://inside.fifa.com/official-documents?filterId=SLT0ebe8e79-ed7f-4011-80f7-09f9807f9ac6).

AUTOGRAPHS OR PERSONAL PHOTOS WITH PLAYERS OR TEAM OFFICIALS ARE STRICTLY PROHIBITED; ANY ATTEMPT TO OBTAIN SUCH AN AUTOGRAPH AND/OR PERSONAL PHOTO SHALL RESULT IN THE IMMEDIATE CONFISCATION OF THE CREDENTIAL CARD.

MEDIA 

Bearers shall only use his/her credential card while on a valid, specific assignment at an Event on behalf of his/her Employer. A credential card shall not be used to enter, or remain at, any Event for personal, non-professional purposes (including, without limitation, attending or watching a match as a fan). The unauthorized use of a credential card shall subject the Bearer and his/her Employer to the immediate revocation of the Bearer’s credential card, ejection from the Event, and prosecution for criminal trespass, without limiting any other rights and remedies at law or in equity.

The use of any account, description, picture, photograph, video, audio, reproduction, or other information concerning the Events other than for rights for news coverage of, or magazines, books, or stories about, the Events is strictly prohibited, except (a) with the prior written consent of Concacaf or its designee, and (b) as specifically licensed by Concacaf. Nothing in these terms and conditions authorizes or allows Bearer to violate any of the Concacaf or Event trademarks, copyright, and other proprietary rights.

In connection with any video and/or audio of the Event distributed by Concacaf and/or an applicable Concacaf rightsholder, Bearer may only utilize the network feed provided by Concacaf, the applicable Concacaf rightsholder, or either of its designees, and Bearer shall not alter the network feed (e.g., removing network graphics or bugs/logos) in any manner without prior written approval of Concacaf and/or the applicable Concacaf rightsholder, or either of its designees. Bearer hereby agrees to comply with the applicable terms and conditions of Concacaf’s Media Guidelines (accessible via the Concacaf Media Hub at media.concacaf.com).

Real-time transmission of streaming video, digital images, real-time audio, including play-by-play and statistics, of any Event is exclusive to Concacaf and/or Concacaf rightsholders. By way of example, a Bearer may blog during any Event, provided that such blog may not produce in any form a real-time description of the Event (i.e., any simulation or display of any kind that replicates or constitutes play-by- play of a material portion of an Event, other than periodic updates of scores, statistics, or other brief descriptions of the Event). If Concacaf deems in its sole and absolute discretion that Bearer is producing a real-time description of the Event, Concacaf reserves all actions against Bearer, including, but not limited to, the revocation of the credential card. As used herein, “real-time” means a continuous play-by-play account or live, extended live/real-time statistics, or detailed description of an Event.

Concacaf is the exclusive owner of all trademarks, trade names, copyrights, and other proprietary rights in the Events, and in any telecast, broadcast, transmission, and/or recording thereof, and no rights are conferred to, or intended to be conferred to, or created on behalf of, Bearer or his/her Employer by way of his/her credential card. Member associations’ and/or participating teams’/clubs’ names, logos, trademarks, crests, mascot, and other intellectual property are controlled by each respective organization and/or league. Concacaf’s and/or a member association’s, participating team’s/club’s name may only be used for news purposes directly related to their participation in the Event.

The credential card confers on Bearer a limited, non-exclusive, and non-transferable license to take still photographs of the Events, and to allow his/her Employer to take the photographs to use such photographs, only for news coverage of, or magazines, or stories about, the Events, other editorial purposes, and reprints of news pages from the Employer’s publications, provided that such use is not likely to create, or does not actually create confusion in the minds of the trade or public that Bearer or its reprints or any elements therein, or the items on which they are reprinted, are sponsored or endorsed by, or are associated or affiliated with Concacaf or that Concacaf licensed Bearer or his/her Employer to use its trademarks or copyrights. Neither the Bearer nor his/her Employer may sell photos taken at the Events to third-party entities, including but not limited to other commercial entities or the general public, unless otherwise licensed by Concacaf.

The Bearer agrees that by accepting a credential card, the Bearer shall be deemed to have granted to Concacaf and its official partners a worldwide, irrevocable, perpetual, sub-licensable, royalty-free license to all rights associated with any picture, photograph, image, video, audio, livestream, or other form of exploitation or reproduction of the Events created or generated by the Bearer, including for or on behalf of his/her Employer.

Any secondary use of any picture, audio description, videotape/film, or drawing of the Events taken or made by the Bearer or his/her Employer to whom this credential card has been issued (including, but not limited to, non-editorial, advertising, sales promotion or merchandising) is prohibited without prior written approval of Concacaf or its designee.

Radio stations that are not Concacaf rightsholders shall not carry any real-time broadcast report on a live or near-live basis or any live description of any Event while it is still in progress and are subject to all other requirements set forth in Concacaf’s Media Guidelines.
